1.Introduction

1.1 Section 101 of the Local Government Act 1972 permits a council to delegate performance of its statutory and legal responsibility to a committee, subcommittee, an officer of an authority or another local authority

When a council delegates its responsibilities to committee, sub-committee, officer or another local authority, they are acting for and on behalf of the council.

2. Delegation to Clerks and Responsible Financial Officer

2.1 The Officers (Clerks and Responsible Financial Officer) are the executors of Council policy and take many administrative and operational decisions on how they go about their day-to-day work within the councils’ rules. They will exercise these powers in accordance with:

• Standing Orders
• Financial Regulations
• Code of Conduct
• Policies
• Committees Terms of Reference
• Burial Ground Rules
• Allotment Rules
• Vestry Hall hire rules
• any statutory obligations/regulations in force at the time.

3. Urgent Decisions of Council

3.1 Urgent decisions required between scheduled meetings of the council are delegated to the Clerk in consultation with the Chairman of the council and/or the committee Chair. Emergency expenditure up to £2000 whether or not there is budgetary provision for the expenditure, in consultation with the Chairman/Vice Chairman of Council as appropriate to the circumstances.

3.2 Decisions made under this delegation will be reported to, and recorded in the minutes of, the next council meeting or appropriate committee meeting.

3.3 Under this delegation, where appropriate, the Clerk may decide that an extraordinary meeting of the council be called to deal with the urgent matter.

4. Committee Delegation

4.1 Due to the large number of applications and the short time scale, a Planning and Preservation Committee was set up by the Parish Council in 1974 to look at the plans, which is delegated to make recommendations to the Borough Council on behalf of the Council. The Committee meets on the 1^st and 3^rd Tuesday of each month.

4.2 All other Committees decisions are ratified at the following Full Council meeting.
